Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her decision, the judge noted that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
